GENERAL RELEASE FORM FOR MINOR
PLEASE READ THIS RELEASE AND WAIVER OF LIABILITY FOR MINOR (THIS “RELEASE”) CAREFULLY BEFORE YOU SIGN IT. BY SIGNING THIS RELEASE, YOU WILL BE WAIVING LEGAL RIGHTS.
In consideration for allowing the above named Minor to attend the Panther City Lacrosse Club Youth Event, TryLax Clinic @ Dickies Arena, Fort Worth on 4/1/2023 (“Events”), I, as Guardian of Minor, for myself, and on behalf of Minor and his/her parents, heirs, executors, administrators, next of kin, successors, and assigns, all of whom shall be legally bound by this Release, hereby agrees to indemnify, defend and hold harmless the Panther City Lacrosse Club, LAX Partners LLC, Dickies Arena, The National Lacrosse League and their respective parents, subsidiaries, affiliates, directors, officers, governors, employees, agents, licensees and designees (the “Released Parties”) from and against any and all claims (including third party claims), causes of action (at law or in equity), suits, damages, liability, demands, lost cost or expense, of any nature whatsoever, known or unknown, directly or indirectly relating to or arising in connection with (i) personal injury and property damage in any manner relating to Minor’s participation in the Event, (ii) Guardian or Minor’s breach of any of its representations, warranties, covenants or agreements set forth in this Release or (iii) acts, omissions or willful misconduct of Guardian or Minor.
Guardian agrees to and does hereby forever release, discharge, exonerate and covenant not to sue the Released Parties, of and from all manner of action or actions, cause or causes of action, suits, claims, demands, damages, liability, lost cost or expense, of any nature whatsoever, whether at law, in equity, or otherwise, known or unknown, fixed or contingent (hereinafter referred to as “Claims”) which Minor and/or Guardian may have or hereafter have against the Released Parties. Guardian understands and agrees that this Release forever discharges the Released Parties from any Claims that Guardian or Minor may have against the Released Parties including, without limitation, Claims with respect to any bodily injury, personal injury, illness, death, or property damage or loss that Minor may sustain as a direct or indirect result of (i) the Released Parties’ negligence (whether active or passive), (ii) Minor’s participation in the Camp, and/or (iii) any and all risks assumed by Minor and/or Guardian hereunder.
Guardian understands and acknowledge that Minor’s participation in the Event may require Minor to engage in physical activity that may be strenuous and/or potentially dangerous and is not aware of any reason, medical or otherwise, why Minor should not participate in the Event. Guardian expressly assumes all risk of illness, injury (including, without limitation, permanent disability) and death to Minor and/or Guardian which relates to or arises directly or indirectly out of Minor’s participation in the Event, howsoever caused or arising and whether by negligence or otherwise, and accept personal responsibility for the damages following such illness, injury, permanent disability or death.
Minor and Guardian hereby grant full permission to the Released Parties, by any means, whether now known or hereafter developed, to exhibit, record, reproduce, broadcast, transmit, publish, sell, distribute, perform, use and re-use, and to license others to exhibit, record, reproduce, broadcast, transmit publish, sell, distribute, perform, use and re-use, for any purpose, in any manner without further notification, authorization or compensation to Minor, Guardian or anyone on behalf of Minor or Guardian, Guardian’s name, voice and/or likeness, and any photographs, videotapes, motion pictures, recordings, or other record of the Event (or any part or parts of my Event) in any and all media, whether now known or hereafter developed, worldwide and in perpetuity, and I represent and warrant that no further permission is required for the Released Parties to use the Event r Minor’s name, voice and/or likeness as provided herein.
GUARDIAN UNDERSTANDS THAT BY SIGNING THIS RELEASE, GUARDIAN IS GIVING UP MINOR’S AND GUARDIAN’S LEGAL RIGHT TO SUE THE RELEASED PARTIES AND/OR TO SEEK COMPENSATION FROM THE RELEASED PARTIES FOR ANY INJURIES AND/OR DAMAGES THAT MINOR OR GUARDIAN MAY INCURE AS A RESULT OF THE ACTIVE OR PASSIVE NEGLIGENCE OF THE RELEASED PARTIES, MINOR’S PARTICIPATION IN THE EVENT, AND/OR ANY RISKS ASSUMED BY MINOR AND/OR GUARDIAN HEREUNDER.
This Release shall be governed by and construed in accordance with the laws of the State of Texas.
In the event that any provision of this Release shall be held invalid, illegal or unenforceable under applicable law, the remainder of this Release shall remain valid and enforceable.
It is the policy of the Released Parties, that in the event of an emergency, Event personnel are to call 911. The contact information provided on this Release will be used as the emergency contact information for Guardian.
By signing below, I represent that I am over 18 years of age, am competent to contract in my own name, have the right to enter into this Release on behalf of myself and that I am the parent or legal guardian of Minor duly authorized to execute this Release on his/her behalf.
